specific version of 1994's contract with america. the setting was a lumber company in northern virginia, the key points are these. a halt to any stimulus spending that hasn't gone out yet. and a rollback of overall spending to prestimulus, prebailout levels. repeal of the health care reform law. permanent extension of the bush era tax cuts for everybody. along with new tax breaks for small businesses. a freeze in nonsecurity related federal hiring and a requirement that all new legislation pass a constitution check. those last two points are a nod to the tea party which by the way handed several republican candidates their hats in this year's primaries. some brand new polling is boosting republican hopes in the november senate races with one big exception. our cnn senior political editor joins me from d.c. with the stories behind these numbers. let me get started with the numbers. then i want to hear what you to say about it. in pennsylvania, former republican congressman pat toomey leads joe sestak 49% to 44%. wisconsin republican ron johnson leads three-term incumbent russ feingold, 5

, hurricane warnings from virginia beach southward to just outside of jacksonville, north carolina near camp lejeune. as far as our commuter models go, everything is taking it offshore at this point. the only close call is out there at nantucket, martha's vineyard, chatam. it should be a category 3 and then a category 2 by the time it's south of new england, weakening to a category 1 as it impacts either down east maine, they're probably going to get hit good saturday morning. the tropical storm force winds, the worst where stephanie is located, and then as everyone drives to work tomorrow, delaware and coastal new jersey and then we take that wind field up into virginia on friday evening. the worst of it is out to sea, but it's still going to put on quite a show in the outer banks and there in cape cod. >> and as you say, 125-mile-per-hour winds is nothing to take lightly. >> there will be damage done from this storm. >> earl's impact expected in north carolina late tonight as we're hearing from bill. thousands are evacuating from the coast, forced to forego their weekend plans as we head i

right. breaking news overnight because this is happening in virginia. a woman has been executed for the first time in almost 100 years. theresa lewis was convicted in 2003 of plotting the murder of her husband and stepson. she apparently wanted their insurance money. she died by lethal injection. lewis' final words were for her stepdaughter. >> miss lewis did make a last statement. she said i just want kathy to know i love her. and i'm very sorry. >> protesters were outside the prison arguing that lewis was treated unfairly, apparently he was very close to the i.q. line where you're not supposed to get executed. police trying to figure out who killed a nicaraguan diplomat in his apartment in the bronx here in new york. he was found on the floor. his throat had been slashed. this just hours before he was scheduled to attend the u.n. general assembly. witnesses say there was a fight in the apartment the night before the murder. police believe he probably knew his killer. >> people filling sandbags now all across southern minnesota and western wisconsin. that's going to happen a

a month ago a judge in virginia declined to throw out a lawsuit filed by that state, making similar claims that the obama health care plan requirement is unconstitutional. the judge wasn't clear about which parts. it's more than he wuntd clear. he just declined to say which parts of the case he would throw out. this case in florida makes two claims. the constitutional claim, and then they also say that the state should not have to pay additional medicaid costs. that it's unconstitutional to require them to come up with the money for the program. he didn't say which parts he'll throw out. the fact that he'll let the case continue is another tactical victory for critics of the plan. >> thank you very much, pete williams. again, that ruling from the judge is expected october 14th. thank you, pete. >>> and right now hurricane igor is pushing across the atlantic on a track that could take it directly to bermuda. igor is expected to remain a dangerous category 4 hurricane through thursday before it reaches the bahamas this weekend. then forecasters believe it will downgrade it to a cat 2. julia
